HomeMy WebLinkAboutOrdinance - City Council - Regular - 3376 - 1/16/2007ORDINANCE NO. 3376 AN ORDINANCE To Be Entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FORT MYERS, FLORIDA, GRANTING A PLANNED UNIT DEVELOPMENT FOR TREELINE PRESERVE LOCATED NORTH OF LEE BOULEVARD, SOUTH OF BUCKINGHAM ROAD, AND EAST OF THE FORUM BOULEVARD IN PART OF SECTION 25, TOWNSHIP 44 SOUTH, RANGE 25 EAST AND PART OF SECTION 26, TOWNSHIP 45 SOUTH, RANGE 25 EAST, FORT MYERS, LEE COUNTY, FLORIDA; RESCINDING ORDINANCE NO.3283, PROVIDING FOR SEVERABILITY, SCRIVENER'S ERRORS, AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF FORT MYERS, FLORIDA, that: SECTION 1. Treeline Preserve, LLC, owner, has requested a planned unit development for Treeline Preserve, formerly known as Colonial Plaza, on the hereinafter described property. SECTION 2. The parcel of land for which planned unit development is granted, is described as follows: PARCEL 1 A tract or parcel of land lying in that portion of Sections 25 and 26, Township 44 South, Range 25 East, Lee County, Florida, being described as follows: Commencing at the northeast corner of the Northwest Quarter (NW1/4) of said Section 25, run S00°38' 15"E along the east line of said Northwest Quarter (NW1/4), for 780.09 feet; thence leaving said east line run S89°21'45"W, for 40.00 feet to the Point of Beginning: From said Point of Beginning run S00°38' 15"E along a line 40.00 feet westerly of and parallel with said east line of the Northwest Quarter (NW 1/4) for 1,656.52 feet to the northerly line of those lands described in Official Record Book 2422, Page 2776, of the Public Records of Lee County, Florida; thence S88°46'36"W along said northerly line, 850.93 feet to a point of intersection with the northeasterly right-of-way line of State Road No. 82 (Immokalee Road) (200 foot right-of-way) as shown on Florida Department of Transportation right-of-way map, Section No. 1207-101; thence N46°07'56"W along said northeasterly right-of-way line, 2,297.54 feet to the beginning of a curve; thence northwesterly along the arc of a curve to the left (radius 5,011.07 feet) (delta 04°34'06") (chord bearing N48°25'33"W) (Chord 399.44 feet), for 399.54 feet to a point of intersection ORDINANCE NO. 3376 with the southerly right-of-way line of Buckingham Road as shown on a Lee County Department Of Transportation Specific Purpose Survey dated April8, 1992, and as described in Official Record Book 3036, Page 3257, of said public records; thence along said southerly right-of-way line N46°47' 19"E, for 218.52 feet to the beginning of a non -tangent curve; thence easterly along said southerly right-of-way line and the arc of a curve to the right (Radius 743.51 feet) (Delta 42°00' 15") (Chord bearing N67°45'33"E) (Chord 532.95 feet), for 545.08 feet; thence N88°45'47"E, 1,488.99 feet to the northwest corner of those lands described in Official Record Book 4148, Page 3142; thence S00°38' 15"E along the west line of said lands, 580.00 feet; thence N88°45'47"E along the south line of said lands, 640.00 feet to the Point of Beginning. The above describes an area of approximately 90.20 acres of land. Subject to a Florida Power & Light Company easement over and across the easterly 290.00 feet. Subject to easements, restrictions and reservations of record. TOGETHER WITH: PARCEL 2 A tract or parcel of land lying in that portion of Section 25, Township 44 South, Range 25 East, Lee County, Florida, being described as follows: Commencing at the northeast corner of the Northwest Quarter (NW-/4) of said Section 25, run S00°38' 15"E along the east line of the Northwest Quarter (NW 1/4) of said section, for 2542.20 feet to the southerly line of those lands described in Official Record Book 2422, Page 2776, of the Public Records of Lee County, Florida and the point of beginning: From said point of beginning run N88°46'36"E along said southerly line, 382.30 feet to a point of intersection with the northwesterly right-of-way line of Lee Boulevard (250 foot right-of-way) as shown on Lee County Department of Transportation Right -Of -Way Map Project No. 4026 and a point on a non -tangential curve; thence southwesterly along said northwesterly right-of-way line and the arc of a curve to the left (Radius 1,557.39 feet) (Delta 17° 14'53") (Chord bearing S52°29'59"W) (Chord 467.06 feet), for 468.83 feet; thence S43°52'32"W, 364.41 feet to a point of intersection with the northeasterly right-of-way line of State Road No.82 (Immokalee Road) (200 foot right-of-way) as shown on Florida Department of Transportation Right -of -Way Map, Section No. 1207-101; thence N46°07'47"W along said northeasterly right-of-way line, 753.37 feet to a point of intersection with said southerly line of lands described in Official Record Book 2422, Page 2776; thence 2 ORDINANCE NO. 3376 N88°46'36"E along said southerly line, 784.19 feet to the point of beginning. The above describes an area of approximately 6.72 acres of land. Subject TO A Florida Power & Light Company easement as recorded in Official Record Book 260, Page 762 and Official Record Book 814, Page 673. Subject to easements, restrictions and reservations of record. BEARINGS herein above mentioned are state plane for the Florida West Zone (NAD 1983/90 Adjustment) and are based on the east line of the northwest quarter (NW1/4) of Section 25 to bear S00°38'15"E. SECTION 3. The purpose and intent of the planned unit development is to allow for the construction of townhome or multi -family residential units in conjunction with commercial uses on property located north of Lee Boulevard, south of Buckingham Road, and east of The Forum Boulevard. SECTION 4. The deviations from the Growth Management Code for the Planned Unit Development are as follows: (1) City Code Requirement: Sec. 118-35(e)(2). Application of district regulations. (e) Yards, generally provisions shall apply to yards: The following general (2) Accessory buildings or structures. The setbacks for accessory buildings or structures shall be the same as those required for buildings in the district in which they are located, except that buildings or structures may have the side and rear setbacks reduced by fifty (50) percent when they are accessory to residential uses and when located on the 3 ORDINANCE NO. 3376 rear half of the lot, excluding street side yards on corner lots and waterfront yard setbacks. Deviation: The minimum required rear setback for non-residential accessory structures shall be ten (10) feet. (2) City Code Requirement: Sec. 118-61(e)(4). Schedule of district regulations. (d) Townhomes (1) Minimum lot size (s.fl: 1,350 Deviation: The minimum lot size shall be nine hundred fifty (950) square feet for townhome units. (3) City Code Requirement: Sec. 118-61(e)(2) Schedule of district regulations. (e) Townhomes (2) Width: 15 feet Deviation: Townhome lots along a curvilinear street where side lot lines are not parallel shall be measured from the midpoint of the side lot lines for minimum lot widths of fifteen (15) feet. (4) City Code Requirement: Sec. 118-61(e)(3). Schedule of district regulations. (e) Townhomes (3) Depth: 90 feet Deviation: The minimum lot depth shall be fifty-five (55) feet for townhome units only. (5) City Code Requirement: Sec. 118-61(e)(4). Schedule of district regulations. (e) Townhomes (4) Minimum living areas (s.f.) per dwelling: C! ORDINANCE NO. 3376 Efficiencies and one bedroom: (700) square feet Two bedrooms: 1,000 square feet (add 200 sq. ft. for each additional bedroom over two bedrooms) Deviation: The minimum living area shall be five hundred eighty (580) square feet for one bedroom units, nine hundred (900) square feet for two (2) bedroom units and one thousand one hundred (1,100) square feet for three (3) bedroom units, on owner occupied units only. (6) City Code Requirement: Sec. 118-61(d)(5). Schedule of district regulations. (d) Multiple Family Dwellings (5) Maximum lot coverage: 45% Deviation: The maximum lot coverage shall be fifty percent (50%) for multi -family and commercial development only. (7) City Code Requirement: Sec. 134-53. Driveway width. The minimum width of a commercial, industrial, or multiple -family residential drive shall be 24 feet. The minimum width of residential single-family and two-family driveways shall be 12 feet. The minimum width of a townhome or single-family attached driveway shall be ten feet. The maximum width of all driveways shall be 40 feet. The width of a driveway shall be measured along the line parallel to the centerline of the street at the terminus of the radius. Wider driveways may be approved by the public works department where the driveway is to be constructed with medians and J or deceleration, acceleration, multiple 5 ORDINANCE NO. 3376 turn lanes or additional turn radius to minimize interference with through traffic. Deviation: A reduced driveway width of eight (8) feet shall be permitted for townhome and multi -family units only. (8) City Code Requirement: Sec. 134-79(a). Sidewalks/sidewalk ramps. (a) All streets shall be provided with sidewalks on each side of the street. Private streets, within gated communities, are permitted to provide sidewalks on one side of the street. The sidewalk may be constructed on the individual lots at the conclusion of the house construction, and prior to the certificate of occupancy. The intent is to permit the sidewalk to be constructed on a lot -by -lot basis after the heavy construction has been completed so the sidewalk is not damaged during construction and to ensure the construction of the sidewalks and driveways at the same elevation. Sidewalks that are to be constructed on a lot -by -lot basis prior to certificate of occupancy shall be clearly shown on the construction plans. Sidewalks shall be a minimum of five feet wide, with saw joints at least every five feet. Sidewalks shall be located within the right-of-way, or abutting the right-of-way line. F-type gutter is required when a sidewalk is within five feet of pavement edge. Where a curb is extended past a sidewalk, a sidewalk ramp meeting the state design standards for handicapped facilities shall be installed on both sides of the street. Deviation: Sidewalks shall only be required on only ORDINANCE NO. 3376 one (1) side of the road, in residential areas only, and shall be required to be constructed at the time of individual residential home construction. Sidewalks in common areas will be constructed concurrently with surrounding area. (9) City Code Requirement: Sec 138-4 Buffer yard requirements. (f) The following table identifies five (5) different buffer yard types and the minimum number of trees and shrubs required per one hundred (100) feet. Deviation: To provide a Type B, 15 foot buffer that shall contain five (5) trees and 66 shrubs per 100 linear feet. (10) City Code Requirement: Sec. 118-61(d)(6). Schedule of district regulations. (d) Multiple Family Dwellings 7 ORDINANCE NO. 3376 (6) Maximum building height: Twice the least proposed setback Deviation: To allow a maximum building height of 65 feet for multiple -family dwelling units only. (11) City Code Requirement: Sec. 118-167. Building height. There shall be no limit on the height of structures in the business district one (B-1), except the height shall not exceed twice the least proposed yard setback. Property development regulations for residential uses shall be as set forth for the residential (A-3) district in section 118-61 with the exception that townhomes in the B-1 district shall not exceed 60 feet in height. Two-family attached dwelling units shall not exceed 45 feet in height. Deviation: To allow a maximum building height of 45 feet for commercial buildings. SECTION 6. The terms and conditions for the planned unit development are as follows: a. The Planned Unit Development Amendment is to increase the acreage by 0.6 acres, more or less, for a total of 96.9 acres, more or less, and for the construction of a maximum of 380,000 square feet of commercial, 60,000 square feet of office and a maximum of 800 multi -family residential units. The amount of commercial and office square footage may be reduced based on the Trip Conversion Table located on the site plan, if the maximum number of dwelling units are constructed. This parcel is located north of Lee Boulevard, south of Buckingham Road, east of The Forum Boulevard. L ORDINANCE NO. 3376 b. The applicant shall prepare a subdivision plat in accordance with the subdivision platting requirements of F.S. 177 and Chapter 130 Subdivisions of the Growth Management Code. No site or building permits shall be issued until the subdivision requirements have been fulfilled as required by Chapter 130 of the Growth Management Code. C. Wheel stops shall be provided for all parking spaces not located in driveways. d. Trash receptacles shall be provided for trash pick-up. e. Street lighting shall be provided for all new streets. f. All lighting must consist of full cut-off (90 degree) fixtures that prevent glare, directing illumination away from adjacent residential properties. g. The level of service on S.R. 82 currently functions at a level of service "F". No building permits will be issued until after the applicant enters into a development agreement pursuant to section 163.3221, F.S. The development agreement will include provisions that require the applicant to pay a proportionate share of the roadway improvements necessary to upgrade State Road 82 to an acceptable level of service. The improvements were identified in a master traffic study for State Road 82, initiated by the City. h. The developer shall obtain any required Florida and Lee County Department of Transportation permits prior to construction. Copies of the Notice of Intent shall be provided to the City prior to the issuance of any applicable site permits, as determined by the Engineering Division. i. Driveways shown on the site plan are considered 9 ORDINANCE NO. 3376 conceptual and actual driveway location shall be determined during the review for site work permits. j. The developer shall be required to loop the water main to the new main located on the north side of Lee Boulevard. k. The developer shall design their storm water management system to provide onsite drainage storage capacity for the future widening of State Road 82. If stormwater facilities are proposed within the Florida Power & Light easements, Florida Power and Light approval shall be required. 1. Fire impact fees for the development shall be paid in full at the time of issuance of the first building permit within each phase. M. The developer agrees to pay twenty-fve thousand dollars ($25,000.00) at the time of issuance of the one -hundredth (100th) residential building permit. Said funds shall be held in escrow for landscaping along State Road 82 east of Interstate 75, for installation within the right-of-way between the pavement edge and the Treeline Preserve property lines or within the medians, with preference given to the right-of-way landscaping. The funds provided will be used after widening of State Road 82. n. The access point on Buckingham Road is conceptual. Buckingham Road is a county road and permitting shall be done through Lee County. The location of the access point may be required to shift due to public safety reasons. As an alternative, the access point may be reduced to a right-in/right-out which may require a full access point on Buckingham Road further to the east for residential access. o. The developer agrees to follow the design standards as 10 ORDINANCE NO. 3376 outlined in Exhibit B. P. The applicant shall be subject to all other applicable requirements of the Growth Management Code for site development. q. The planned unit development for Treeline Preserve shall be effective upon approval. Construction shall commence within three (3) years and must be completed within seven (7) years. r. The terms, conditions and deviations for the planned unit development, reflected on the site plan and landscape plan prepared by Barraco and Associates, Inc., with a revision date November 1, 2006, (Exhibit A), shall be binding on the applicant, their successors or assigns. SECTION 7. Ordinance No. 3283 is hereby rescinded. SECTION S. Failure to comply with the terms and conditions of the Planned Unit Development will result in the cancellation of the development approval and the Planned Unit Development approval shall be come void and the underlying land use designation of Mixed Use (MU) shall be restored. The applicant shall be notified in writing of the date of the public meeting to be held by City Council and be given an opportunity to respond at the public meeting. SECTION 9. A notice of public hearing was published in a newspaper of general circulation in accordance with the law. SECTION 10. Severability. If for any reason any provision, paragraph, word, section or article of this ordinance is invalidated by any court of competent jurisdiction, the remaining provisions, paragraphs, words, sections and chapters shall not be affected and shall continue in full force and effect. 11 ORDINANCE NO. 3376 SECTION 10. The purpose and intent of these provisions is to maintain, enhance and complement the streetscape. Buildings shall have architectural features and patterns that provide visual interest from the perspective of the pedestrian; reduce massing aesthetic; recognize local character, and be site responsive. Facades shall be designed to reduce the mass/scale and uniform monolithic appearance of large unadorned walls, while providing visual interest that will be consistent with the community's identity and character through the use of detail and scale. Articulation is accomplished by varying the building's mass in height and width so that it appears to be divided into distinct massing elements and details that can be perceived at the scale of the pedestrian. (See Illustration 4.) ILLUSTRATION # 4 (b) Building/view orientation standards. Buildings must be oriented to maximize pedestrian access, use and view. Facades/elevations that are adjacent to an arterial street shall have two of the following design features; (1) Windows at a minimum of 40 percent of the affected facade; (2) Projected covered public entry with a minimum of 25 percent of the wall space devoted to windows: (3) Covered walkway (excluding canvas type) unless provided with six (6) inch columns or better attached to the building at a ORDINANCE NO. 3376 minimum of eight feet wide with a 60 percent minimum coverage for the affected facade. (c) Facades. (1) No horizontal length or uninterrupted curve of a building facade shall exceed 100 linear feet. For arcaded facades, no horizontal length or uninterrupted curve of the arcaded facade shall exceed 120 feet, but varied lengths are desirable. Projections and recesses shall have a minimum depth of three feet with 25 percent of these having a varied length with a minimum differential of one foot. (2) Exterior wall planes shall not constitute more than 60 percent of each affected ground floor facade. The wall plane shall be measured at one foot off the exterior wall surface on each side of the wall. (3) Primary facades on the ground floor shall have features along a minimum of 50 percent of their horizontal length per affected side. These features include, but are not limited to: arcades, a minimum of six feet clear in width; display windows; entry areas; or other such design elements. Awnings are included in this calculation at 1.5 times the window width when associated with windows/doors and are in increments of 20 feet in length or less. (4) Wall height transition. New buildings that are more than twice the height of any existing building within 300 feet must be designed to provide a transition between buildings of lower height. (See Illustration 5 below.) All primary facades of a building must be designed with consistent architectural style, detail and trim features. b. Buildings must provide a minimum of three of the following building design treatments integrated with the massing and style of the buildings. (See Illustrations 6 and 7 below.) In addition to the above, corner lots at an intersection of two or more arterial or major collector roads must be designed with additional architectural embellishments, such as corner towers, or other such design features, to emphasize their location as gateways and transition points within the community. (d) Roof treatments. (1) Purpose and intent. Variations in roof lines must be used to add interest to, and reduce the massing of buildings. Roof features and materials must be in scale with the building's mass and complement the character of adjoining and/or adjacent buildings and neighborhoods. The following standards identify appropriate roof treatments and features. (2) Roof edge and parapet treatment. At a minimum of two locations, the roof edge and/or parapet shall have a vertical change from the dominant roof condition, a minimum of three feet. One additional roof change must be provided for every 25,000 square foot increment over 100,000 square feet of ground floor space. Sloping roofs, which do not exceed the average height of the supporting walls, must have an average slope equal to or greater than 4V:12H but not greater than 12V:12H; d. Additional vertical roof changes with a minimum change in elevation of two feet (flat roofs must have a minimum of two changes): or e. Three-dimensional cornice treatment which must be a minimum of ten inches in height with a minimum of three reliefs. (4) Prohibited roof types and materials. The following types of materials are prohibited: a. Roofs utilizing less than or equal to a 2V:12H pitch unless utilizing full parapet coverage or mansard; and b. Mansard roofs except roofs with a minimum vertical distance of eight feet and an angle between 45 and 70 degrees from horizontal. (e) Detail features. The design elements in the following standards must be integral parts of the building's exterior facade and must be integrated into the overall architectural style. These elements may not consist solely of applied graphics, or paint. on ORDINANCE NO. 3376 (1) Blank wall areas. Building walls and facades, must avoid large blank wall areas by including a repeating pattern which shall include no less than three of the design elements listed below, in a repeating pattern. At least one of the design elements must repeat horizontally. All design elements shall repeat at intervals of no more than 50 feet, horizontally. a. Color change; b. Texture change; c. Material change; d. Expression of architectural or structural bays, through a change in plane of no less than 12 inches in width, such as a reveal, an offset, or a projecting rib. (See Illustration 10 below); e. Architectural banding; f. Building setbacks or projections; or, g. Pattern change. r 55QQQTURAL BAY ILLUSTRATION #10 (2) Materials. Exterior building materials contribute significantly to the visual impact of a building on the community. They must be well -designed and integrated into a comprehensive design style for the project. a. The following exterior building materials can not be used on more than 50 percent of the building facade area: 1. Plastic/vinyl siding except to establish the "old Florida" look; 2. Corrugated or reflective metal panels; 3. Tile (prohibition does not apply to roofs); 4. Smooth, scored or rib faced concrete block; 5. Any translucent material, other than glass; or 6. Any combination of the above. 7 ORDINANCE NO. 3376 b. Building trim and accent areas, consistent with the overall building, are limited to ten percent of the affected wall area, with a maximum trim width of 24 inches. (3) Colors. a. Predominant exterior building and roof colors shall minimize the use of black, gray, fluorescent, primary and/or secondary colors. Earth -tone colors are encouraged. b. Building trim and accent areas may feature any color(s), limited to ten percent of the affected facade segment, with a maximum trim height of 24 inches total for its shortest distance. (fl Review Requirements. The applicant for a building permit shall submit the following architectural drawings, signed and sealed by a licensed architect, registered in the state of Florida for review by City Planning Staff for compliance with this code. (1) Scaled elevation for all sides of the building; (2) Scaled wall section from top of roof to grade depicting typical elevation with details and materials noted, and rendered to show materials and color scheme with paint chips and roof color samples; (3) Site sections showing the relationship to adjacent structures; N. ORDINANCE NO. 3376 Definitions • Arcade - an area contiguous to a street or plaza that is open and unobstructed, and that is accessible to the public at all times. Arcades may include building columns, landscaping, statuary and fountains. Arcades do not include off-street loading/unloading areas, driveways or parking areas. • Articulate - to give emphasis to or distinctly identify a particular element. An articulated facade would be the emphasis of elements on the face of a wall including a change in setback, materials, roof pitch or height. • Breezeway - a structure for the principal purpose of connecting a main building or structure on a property with other buildings. • Buffer - see also "screen". An area provided to reduce the conflict between two different land uses. Buffers are intended to mitigate undesired views, noise and glare - effectively providing greater privacy to neighboring land uses. Typical buffers consist of materials that serve this purpose and include, but are not limited to, plant materials, walls, fences and/or significant land area to separate the uses. • Buffer Strip - a portion of a lot or property used to visually separate one use from another through the use of vegetation, distance or other approved method. • Building Face, Front - any building face, which can be touched by a line drawn perpendicular to street (public or private). • Building Face, Public - any building side which is visible from public or private right-of-ways and/or the faces that contain public entry. • Building Mass - the building's expanse or bulk and is typically used in reference to structures of considerable size. • Design Guidelines - statements and graphics intended to direct the planning and development of the built environment in a particular manner or style so that the end result contributes positively to the overall development. • Dormer - a window set vertically in a gable projecting from a sloping roof. • Facade - the portion of any exterior elevation on the building extending from grade to the top of the parapet, wall or eaves and extending the entire length of the building. • Gable - a triangular wall section at the end of a pitched roof, bounded by the two roof slopes. • Hip Roof - roof without gables. • Parapet - the portion of a wall that extends above the roofline. • Pedestrian Oriented Development - development designed with an emphasis primarily on the street sidewalk and on pedestrian access to the site and buildings/structures rather than on auto access. The buildings/structures are generally located close to the public or private right-of-way and the main entrance(s) is oriented to the street sidewalk. There are generally windows or display cases along building facades. Although parking is provided, it is generally limited in size and location. • Pedestrian Walkway - a surfaced walkway, separate from the traveled portion of a public or private right-of-way or parking lot/driving aisle. • Portico - a porch or walkway with a roof supported by columns, often leading to the entrance to a building. A ORDINANCE NO. 3376 • Public/Private Right of Way - any public or private road, access easement intended to provide public access to any lot/development, but excluding any service road or internal driving aisles (i.e., within parking lots). • Screen - see also "buffer". The sole purpose of a screen is to block views. A screen should be constructed of opaque materials and whose height will be effective in obstructing unwanted views. • Streetscape - all elements of a development or area that are in view from other points along a street. 10
